These terms of use (the “Terms”) set out how you may use Hanasite (the “Service”), the website builder provided by 株式会社Bekito (“we”, “us”). Please read them before using the Service.
Article 1 (Scope)#
- These Terms apply to everything between you and us regarding the Service.
- Conditions we show in the Service — the pricing page, help pages, the final confirmation screen and the like — are part of these Terms. Where they differ from these Terms, the specific condition prevails.
- Personal information is handled under our separate privacy policy.
Article 2 (Definitions)#
- “You”: an individual or company that has agreed to these Terms and created an account.
- “Account”: your registration for the Service, created with an e-mail address or with a LINE account.
- “Studio”: the screen for creating and changing sites, in a browser or inside the LINE app.
- “AI features”: AI that creates and changes a site's texts, images and code from your typed, spoken or file instructions, plus voice conversations, transcription, reading files and AI support.
- “Site”: a website created with and published on the Service.
- “Content”: texts, audio, photos, logos, documents, price lists, URLs and other information you enter, send or upload.
- “Credits”: the unit that measures use of the AI features.
- “Paid services”: the Standard plan, the founding member package, done-for-you sites, extra work and other services you pay for.
- “Pricing page”: the page on our website showing prices, contents and limits.
- “Site visitors”: third parties who view your site or send information through its forms.
Article 3 (Your contracting party and our operator)#
- Your contract for the Service is with us (株式会社Bekito).
- The Service was developed by Masterbek LLC (Republic of Uzbekistan; the “Operator”), to which we have entrusted its development and operation (including server management, incident response and part of support) 【To be confirmed:licence and outsourcing contract to be signed】.
- We are responsible for the Operator's acts as for our own.
- How the Operator handles personal information, including abroad, is described in the privacy policy.
Article 4 (Agreement and conclusion of the contract)#
- You create an account after agreeing to these Terms. The contract on these Terms is concluded when your account has been created.
- A contract for a paid service is concluded when you press “申し込む” (order) on the final confirmation screen and the payment is complete.
- We record the version of these Terms you agreed to and when.
- If you are under 18, use the Service with the consent of your parent or other legal guardian. If you order for a company or business, make sure you are authorised to act for it.
Article 5 (Accounts)#
- Register accurate information and keep it up to date.
- Keep your password, login links, LINE account and other ways of logging in safe. Actions taken with your account are treated as yours, unless we are at fault.
- Tell us immediately if you notice that someone else has logged in.
- You may not create several accounts to get around the free-trial limits.
Article 6 (What the Service includes)#
- The Service mainly offers the following. Which features and limits each plan has is on the pricing page.
- Creating and changing a site with AI, from typed, spoken or file instructions
- Publishing the site (on a subdomain of the Service or your own domain, with an SSL certificate)
- An inbox for messages sent through your site's forms, with notifications by e-mail and LINE
- Visitor statistics for your site
- Creating and changing your site and receiving notifications on LINE (optional)
- Sites are meant to introduce a shop or business. Online payment, bookings and member management are not part of the Service; if you need them, link to an external service you contract yourself.
- Domain registration and renewal and mailboxes are not part of the Service.
Article 7 (AI output and your review)#
- AI output (texts, images, code …) is generated automatically and may contain errors, inaccuracies, things that do not exist, or things you did not intend.
- Before and after publishing, check your site's content (prices, address, phone number, opening hours, map, menu, qualifications, track record …); you are responsible for it being correct and lawful.
- AI-generated images are illustrations. Do not use them in a way that suggests they are photos of real products, shops or people.
- Check that the content follows the advertising rules of your trade (the Act against Unjustifiable Premiums and Misleading Representations, the Pharmaceuticals and Medical Devices Act, medical advertising guidelines, rules for massage and judo therapists, professional associations' advertising rules, and so on).
- We do not guarantee that output suits your particular purpose or infringes no third-party rights. If output may infringe someone's rights, we help correct or remove it. Damage caused by our fault is governed by Article 27.
Article 8 (Review before publishing; previews)#
- Your first site is created as a preview (draft). It is not public until you have checked it and chosen to publish.
- Later changes also go to the preview first and reach the published site only when you publish.
- Publishing, unpublishing, restoring an earlier version, deleting a site and removing a custom domain happen only when you press the button or clearly answer “yes” to the AI's confirmation.
- A preview's address contains a random string unique to your site, so only people who know the address can open it — and anyone you share it with can. Previews are set not to be indexed by search engines and are not password-protected. “Issue a new preview link” in Settings gives the preview a new address; the old one stops working.
Article 9 (Support)#
- We provide support as follows:
- AI support: 24 hours (in the Studio and on LINE; LINE is optional)
- A person: by e-mail; we reply within 2 business days as a rule
- Phone: weekdays 10:00–18:00 JST (closed weekends, public holidays and New Year; outside these hours, please e-mail us)
- AI answers first: it answers questions, takes bug reports and handles requests to change your site. It may change your site at your request; changes go to the preview first (Article 8) and reach the published site only when you publish.
- If the AI cannot solve it, or you ask for a person, a staff member takes over. Payments, refunds, invoices, account ownership and security are handled by staff.
- You can cancel, ask for refunds and make privacy requests by e-mail (Loading…) or on the account page, without the AI or LINE. A person always handles these requests; the AI never decides or processes them.
- Business days are days other than weekends, Japanese public holidays and the New Year holidays.
- Changes made through support use credits like any other work. Credits used for changes that fix our own bugs are returned on request.
Article 10 (Rights in content)#
- Copyright and other rights in your content stay with you or the rightful owner. You warrant that you have the rights, or the owner's permission, to use the content in the Service and publish it on your site.
- We claim no copyright or other rights against you in the texts, images and code created on your instructions (“output”), except:
- programs, templates and design components we or the Operator already had
- open-source software, fonts and other material under their own licences
- material whose rights belong to third parties
- You let us use your content and output free of charge as far as needed to provide the Service (storing, copying, converting, sending to AI providers, publishing as a site, backups), for the duration of the contract and until the data is deleted under Article 24. Within this permission we may let the Operator and its subcontractors use them.
- We do not use your content or conversations to train AI models.
- We do not present your site as one of our examples without your consent.
- We may use aggregated statistics that identify no person or business (number of tasks, processing time, costs, errors …) to improve the Service.
Article 11 (Our intellectual property)#
The Service's software, the Studio, templates, design system and the “Hanasite” name and logo belong to us, the Operator or the rightful owners. You may use them only to use the Service.
Article 12 (Site visitors' personal information)#
- You are responsible under the Act on the Protection of Personal Information for personal information you receive from site visitors through forms and the like. We handle it on your behalf, only as far as needed to provide the Service (storing it, showing it in your inbox, notifying you by e-mail or LINE, and sending it to the AI when you ask the AI about it).
- Publish your own privacy policy on your site and handle site visitors' information lawfully. Explain there too that the site's information is stored and processed on servers abroad through the Service (the countries are in our privacy policy). A sample text is in section 7 of our privacy policy.
- Do not ask for more sensitive information (medical history, health …) in forms than you need; if you collect it, get the visitor's consent as the law requires.
- You can delete form messages in your inbox at any time. When you delete a site, its messages are deleted as set out in Article 24.
- If a site visitor contacts us about their personal information, we pass it on to you and work with you on it.
- We use the personal information entrusted to us only on your instructions and to provide the Service.
Article 13 (Prohibited use)#
When using the Service, you must not:
- break the law or public order, or do anything leading to a crime
- commit fraud or phishing, list fictitious shops, or impersonate others
- infringe copyright, trademarks, portrait rights, privacy or other rights of third parties
- defame others, harm their reputation, or promote discrimination
- publish obscene material, child sexual abuse material, or material harmful to minors
- sell or advertise illegal drugs, unauthorised medicines or weapons, run unlicensed gambling or pyramid schemes
- publish untrue or exaggerated advertising that misleads consumers
- send spam, or mass messages through the forms or notifications
- gain unauthorised access, plant malware, attack the Service or other systems, or probe for vulnerabilities without permission
- get around limits or technical restrictions (including creating several accounts to repeat the free trial)
- sell or lend your right to use the Service to others without our permission
- collect personal information unlawfully
- interfere with the operation of the Service
- do anything else we have reasonable grounds to consider inappropriate
Article 14 (Hosting)#
- We make reasonable efforts to keep the Service and sites running, but do not guarantee that there will never be interruptions or faults.
- Maintenance that stops the Service is announced in advance where possible and done at quiet times.
- The Service's servers are currently in 【To be confirmed:server location (planned: Finland, EU)】. We plan to move to servers in Japan; if we do, we will update the privacy policy and let you know.
- We back up every day, but keep your own copies of important content too (you can download your data as set out in Article 24).
Article 15 (Custom domains)#
- You register your own domain with a registrar and pay for it yourself; we do not register or renew domains for you.
- Renewing the domain and setting its DNS are your responsibility. If your site stops showing because a domain lapsed, we are not liable unless we are at fault.
- Your domain is yours: after you stop using the Service you can point its DNS elsewhere and keep using it.
Article 16 (Prices and payment)#
- Prices of paid services are shown including consumption tax on the pricing page and the final confirmation screen.
- You pay by credit card through a payment service provider; card numbers are not stored on our servers.
- You pay:
- Standard plan (monthly): first when you confirm the order, then on every renewal date
- Founding member package, done-for-you site: in one payment when you confirm the order
- Price changes never affect periods already paid. For plans that renew automatically we e-mail you at least 【To be confirmed:notice period (proposed: 30 days)】 before the first renewal at the new price; if you do not accept it, you can cancel before then.
- Internet charges, your domain and external services you contract are paid by you.
- We issue an electronic receipt for every payment.
Article 17 (Free trial)#
- The free trial lasts 14 days from creating your account and includes 15 credits, once. No card is needed.
- When it ends it does not turn into a paid plan, and nothing is charged.
- When it ends, publishing and AI features stop. Your site and other data are kept for 30 days from then and deleted afterwards (we e-mail you 7 days before). Order a paid plan in that time and you continue where you left off.
- Trial sites are published on a subdomain of the Service and show that they were made with it 【To be confirmed:whether and how this is shown】.
- One free trial per business. To prevent abuse we may restrict free trials.
Article 18 (Credits)#
- Using AI features (creating and changing sites, generating images, voice conversations …) uses credits.
- Credits used are calculated from the actual AI processing. Before large tasks we show an estimate, and tasks above a certain size start only after you confirm.
- Paid-plan credits are granted with every monthly renewal and do not roll over. The founding member package also grants them monthly.
- Credits cannot be exchanged for money or transferred to another account. Credits from the free trial or campaigns have no monetary value.
- When credits run out, AI work stops; your published site stays online. We never buy or charge for more automatically.
- Failed work uses no credits. Credits used by mistake because of our bug are returned on request.
- You cannot currently buy extra credits. If we offer them in future, purchased credits will expire within six months of purchase, and we will show the conditions beforehand.
- Credits left when a paid plan ends expire.
- Text conversations that do not change your site may have a daily limit per plan.
Article 19 (Automatic renewal)#
- The Standard plan (monthly) renews every month until you cancel. There is no minimum term.
- On each renewal date we charge the current monthly price to your registered card.
- If the payment fails, we try again one day and three days later, and ask you by e-mail (and on LINE if linked) to update your card. If it still fails, the paid plan ends when the period you paid for ends.
- Before each renewal we e-mail you the date and amount 【To be confirmed:how many days before; every month or not】.
- From the day after its first year ends, the founding member package renews monthly as the Standard plan. We e-mail you 30 days and 7 days before the first year ends; cancel by its last day (the day before the first monthly renewal) and nothing more is charged.
- Done-for-you sites and extra work are one-off and do not renew.
Article 20 (Cancellation)#
- You can cancel the Standard plan (stop the automatic renewal) at any time, on the account page under “Plan and payment” 【To be confirmed:screen name】 or by e-mail (Loading…). By e-mail, the time we receive it counts.
- If cancellation is complete by the day before the next renewal date 【To be confirmed:cut-off time】, nothing more is charged.
- After cancelling you can use the Service until the end of the period you paid for.
- We e-mail you a confirmation when cancellation is complete.
- After a paid period ends your site stays online for 7 days and is then paused. Its data is kept for 30 days from the pause and then deleted, except transaction records the law requires us to keep. Order again in that time and everything comes back as it was. We e-mail you 7 days before the deletion.
- Cancelling is separate from deleting your account; to delete your account and data, follow Article 24.
Article 21 (Refunds)#
- If you cancel the Standard plan for your own reasons, amounts already paid are not refunded, not even pro rata.
- The founding member package is refunded in full if you ask before we start the publishing help 【To be confirmed:full refund before start】; it is not refunded if you cancel for your own reasons after we started.
- A done-for-you site is refunded in full if you ask before we start (the interview). If you cancel after we started, we refund the amount minus the work done so far 【To be confirmed:how this is calculated】.
- If we could not provide the Service through our fault, we refund the period we could not provide, or extend your period if you prefer.
- Double or wrong charges are refunded in full.
- Refunds are normally made by reversing the card charge. The period and credits that payment granted are cancelled with the refund.
- This article does not limit any right you have by law.
Article 22 (Done-for-you sites and publishing help)#
- The scope of a done-for-you site and of the publishing help included in the founding member package is in the table below.
- You provide the materials (photos, texts, logo …).
- For requests beyond the scope we send a quote first (¥5,500 tax incl. per 30 minutes) and start after you approve it. We never charge extra without your approval.
- If materials or replies do not arrive, we contact you with a deadline. If there is still no reply, we may complete the work as it stands 【To be confirmed:how completion is handled】.
- If a delivered site differs from what you ordered, tell us within 【To be confirmed:proposed: 30 days】 of delivery and we fix it free of charge.
- Running the site after publication requires a paid plan 【To be confirmed:whether a done-for-you site can be ordered alone】.
| Done-for-you site | Publishing help | |
|---|---|---|
| Interview | 1 | 1 |
| Pages (Japanese) | up to 5 | up to 3 |
| Forms | 1 | 1 |
| Revisions | up to 2 rounds | 1 round |
| Custom domain connection | 1 (a domain you own) | 【To be confirmed:domain connection in publishing help】 |
| Staff time | up to 3 hours in total | up to 45 minutes in total |
Article 23 (Suspension and termination)#
- We may suspend your site's publication or your account in the following cases. Except in emergencies we tell you why beforehand; after an emergency suspension we tell you promptly.
- conduct prohibited by Article 13
- registered information turns out to be untrue
- fees are not paid
- it is necessary to protect the Service or other systems
- a court or authority requires it
- If you breach these Terms and do not remedy it within a reasonable period after we ask, we may terminate the contract; for a serious breach where asking is clearly pointless, immediately.
- If the contract is terminated under this article, fees already paid are handled as the law provides.
Article 24 (Downloading and deleting your data)#
- You can download your data as a ZIP file at any time under Account → “Data and account”: your sites' files (published and newest versions), uploaded files, form messages (CSV) and your conversations. We e-mail you when it is ready, and it can be downloaded for 7 days. This also works during the retention period after a paid period ends (30 days from the pause).
- You can delete a site in the Studio at any time (you are asked to confirm). A deleted site goes offline at once, and its data (including its GitHub repository) is erased 30 days after the deletion.
- You can delete your account at any time under Account → “Data and account”, or ask us by e-mail. You are signed out at once, and your sites' publication and automatic renewal stop. Your account, sites, conversations, uploaded files, form messages, support records and LINE link are erased within 30 days, and we e-mail you a confirmation.
- Erased data also leaves our backups within 30 days. Transaction records the law requires for accounting and tax (orders, payments, receipts, and the name and e-mail address they need) are kept for the legal period.
- Retention periods are in the privacy policy.
Article 25 (Changes to and end of the Service)#
- We may change or add features, and may change AI providers or models. We do not reduce a plan's main features during a period you have paid for.
- If the companies or countries handling personal information change, we update the privacy policy and let you know.
- If we end the Service, we tell you at least 【To be confirmed:notice period (proposed: 60 days)】 beforehand, let you take your site data, and refund paid periods not yet used.
Article 26 (External services)#
Use LINE, payment service providers, domain registrars and other external services under their own terms. We are not liable for damage caused by their outages or faults unless we are at fault.
Article 27 (Liability)#
- If you suffer damage through our fault, we compensate you.
- Even so, only where we acted without intent or gross negligence (slight negligence), our liability is limited to ordinary damage you actually suffered, up to the total fees you paid us for the Service in the 12 months before the event that caused the damage 【To be confirmed:how the cap is set】.
- The limit in the previous paragraph does not apply where we acted with intent or gross negligence.
- If your breach of these Terms causes us damage, you compensate us.
Article 28 (No anti-social forces)#
- You and we each represent and warrant that neither we nor our officers are, or will become, members of organised crime groups, persons who left such groups less than five years ago, associates, affiliated companies, corporate racketeers, groups using social movements as a pretext, special intelligence crime groups or similar (“anti-social forces”).
- You and we each promise not to make violent or unjustified demands, use threats, damage the other's reputation by rumours or deception, or obstruct business, directly or through others.
- If the other party breaches the previous two paragraphs, the contract may be terminated immediately by notice, without liability for the damage this causes the other party.
Article 29 (Changes to these Terms)#
- Under Article 548-4 of the Civil Code we may change these Terms without your individual consent when:
- the change is in the general interest of customers, or
- the change does not contradict the purpose of the contract and is reasonable in view of its necessity, the appropriateness of the new terms and other circumstances.
- Before a change takes effect we publish the new Terms and the effective date on our website and e-mail you. For changes to your disadvantage we do so at least 【To be confirmed:notice period (proposed: 30 days)】 before they take effect.
- If you do not accept a change to your disadvantage you can cancel before it takes effect; paid periods not yet used are then refunded 【To be confirmed:refund of unused periods】.
Article 30 (Notices)#
- We notify you by e-mail to your registered address, in the Service, or on LINE (if linked).
- An e-mail sent to your registered address is deemed received when it would normally arrive.
- Important requests — cancellation, refunds, privacy requests — can always be made by e-mail; LINE is never the only channel.
Article 31 (Assignment)#
- You may not assign your position or rights and obligations under the contract without our prior consent.
- If we transfer the business of the Service, we may transfer the contract position, rights and obligations and your information to the transferee; we will tell you beforehand.
Article 32 (Severability)#
If any provision of these Terms is invalid or rescinded by law, the rest stays in force, and the invalid provision is applied in the meaning closest to its purpose that the law allows.
Article 33 (Governing law and jurisdiction)#
- These Terms and the contract are governed by Japanese law.
- Disputes about the Service are first discussed in good faith.
- If they cannot be settled that way, the Tokyo District Court has exclusive jurisdiction in the first instance.
Article 34 (Language)#
These Terms are written in Japanese. Where we show a translation, the Japanese version prevails.
Supplementary provision: these Terms take effect on 8 October 2026.
